This website, www.BusinessAhead.Net, is operated by Computer Solutions under the brand name Business Ahead (“we”, “us”, “our”). It exists to describe our products and services, to publish material we think is useful, and to allow customers to register and place Orders.

The information on it is published in good faith and kept current so far as we reasonably can, but it is general in nature. This Disclaimer sets out the basis on which we make it available, and the limits of our responsibility for it.

Section 9 limits our liability to you. If you are a customer, the limits in your contract apply instead, as explained in Section 1.2. Nothing in this Disclaimer excludes any liability that cannot lawfully be excluded, and Section 9.5 preserves your rights as a consumer.

  1. Scope and Precedence#

    1. Who This Applies To.

      This Disclaimer applies to everyone who accesses this website: visitors who never become customers, prospective customers evaluating our services, and existing customers browsing the public pages.
    2. Customers: The Terms of Service Prevail.

      If you are a customer, your relationship with us in respect of the Services you have purchased is governed by our Terms of Service. In particular, the disclaimers in Section 15.6 and the limitation of liability in Section 17 of that document apply to the Services and prevail over this Disclaimer to the extent of any inconsistency. This Disclaimer does not increase, reduce or otherwise vary the liability caps agreed in Section 17.3 of that document.
    3. Non-Customers.

      If you are not a customer, you have no contract with us. This Disclaimer, together with our Copyright Policy, sets out the terms on which we make this website available to you, and Section 9.4 states the limit of our liability.
    4. Other Documents.

      Personal data is dealt with in our Privacy Policy and intellectual property in our Copyright Policy. Nothing here limits any right you have under those documents or under applicable data protection Law.       We take commercially reasonable measures to protect this website, but no website or transmission over the internet is completely secure. We do not warrant that this website or any material downloaded from it is free from viruses, ransomware or other harmful components, and we are not liable for loss or damage caused by any such component infecting your equipment. You should use your own virus protection and keep your software patched. You must not introduce malicious code, attempt to gain unauthorised access to this website or its servers, or conduct penetration testing or load testing without our prior written consent, which may be an offence under the Information Technology Act, 2000. If you discover a vulnerability, please report it privately to and allow us a reasonable opportunity to fix it before disclosing it.

  5. Pricing, Currency and Quotations#

    1. Invitation to Treat.

      Prices, packages, specifications and descriptions published on this website are an invitation to treat, not an offer capable of acceptance. No contract arises until we accept your Order under the Terms of Service. Published prices may change at any time without notice; the price applicable to your purchase is the one confirmed in your Order or invoice, and renewal pricing is governed by Section 12.1 and Section 12.2 of that document.
    2. Pricing Errors.

      If an obvious pricing or specification error appears on this website, we are not obliged to supply at the erroneous price, even after an Order has been submitted. We will tell you promptly and give you the choice of proceeding at the correct price or cancelling with a full refund of anything paid.
    3. Currency Display.

      This website allows prices to be displayed in Indian Rupees (INR) or United States Dollars (USD). Where a currency other than the currency of invoice is displayed, the amount shown is an indicative conversion for convenience only, calculated using a periodically updated reference rate. It is not a quotation and not a guaranteed rate, and may differ from the amount finally charged. The binding amount is that stated on your invoice in the invoicing currency determined under Section 12.5 of the Terms of Service.
    4. Taxes and Quotations.

      Displayed prices are exclusive of Goods and Services Tax and other taxes, which are applied as described in Section 12.4 of the Terms of Service. Bank charges, gateway fees and conversion costs applied by your own bank or card issuer are borne by you and are outside our control. A quotation or proposal is valid only for the period stated in it, or thirty (30) days if none is stated, and is subject to the scope assumptions recorded in it; work outside that scope is Additional Work under Section 8.2 of the Terms of Service.

  6. Illustrations, Testimonials and Results#

    1. Screenshots and Demonstrations.

      Screenshots, mock-ups, sample dashboards, demonstration data, videos and feature illustrations show how our products work in principle. They may depict configurations, integrations or branding that are not part of a standard package, and the interface you receive may differ. What you are entitled to receive is determined by the specifications on the relevant Service page and by your Order, which together form the Acceptance Criteria under the Terms of Service; where a marketing description and a specification differ, the specification and the Order prevail.
    2. Roadmap and Trials.

      Any statement about planned features or future releases is an expression of current intention only, not a commitment, and you should not purchase in reliance on it. Any demonstration, sandbox or trial environment is provided for evaluation only, without warranty, service level or backup; data entered into it may be reset at any time and should never include real personal data or business records.
    3. Testimonials.

      Testimonials, customer references and case studies are the genuine views or experiences of the customers concerned, published with their consent under Section 14.8 of the Terms of Service, and reflect individual circumstances. Results described in them are not typical, average or guaranteed, and are not a prediction of the results you will obtain. We may edit a testimonial for length or clarity but not so as to change its meaning, and a customer may withdraw consent at any time.
    4. No Guarantee of Outcomes.

      Nothing on this website guarantees any business outcome, including increased sales, enquiries, revenue, cost savings or return on investment. We do not guarantee search engine rankings, traffic, conversions or approval of advertisements by any platform, since those platforms operate independently of us and change their algorithms without notice; the contractual position is at Section 8.9 of the Terms of Service. Statements about page speed, uptime or capacity are indicative and are not warranties unless your Order says so. Where we describe a product as supporting a standard or regulatory requirement, we mean it provides functionality intended to assist you in meeting it; responsibility for your own compliance, validation or certification remains yours.

    1. Disclosure and Accuracy.

      Some material published on this website, and some material produced in the course of our services, may be drafted or illustrated with the assistance of AI Tools, as disclosed in Section 8.8 of the Terms of Service and in our Privacy Policy. AI-generated material can be confidently wrong. We review what we publish, but we do not warrant the factual accuracy, completeness, currency or originality of AI-assisted material, and Section 3 and Section 4 apply to it in full.
    2. Assistants and Customer Deliverables.

      Where this website offers an automated assistant, chatbot or search summary, its responses are generated automatically, are informational only, are not advice and do not bind us; where the answer matters, confirm it with us in writing. For work delivered to customers, responsibility for reviewing and approving AI-assisted content before publication rests with the customer under Section 8.8 of the Terms of Service.

      Where we host a website or system for a customer, that customer is responsible for its content under Section 9.2 of the Terms of Service. We do not endorse and are not responsible for it. Complaints about such content should follow the procedure in our Copyright Policy. Material you send us through a form or email is dealt with under that Policy, and any personal data it contains under our Privacy Policy.

  9. Limitation of Liability#

    1. Customers.

      If you are a customer, our liability in respect of the Services is governed exclusively by Section 17 of the Terms of Service, including the aggregate cap in Section 17.3.1 and the time limit for claims in Section 17.5. This Section 9 does not add to, reduce or otherwise vary those provisions.
    2. Exclusion of Damages.

      To the fullest extent permitted by applicable law, we will not be liable, whether in contract, tort (including negligence), statute or otherwise, for any indirect, consequential, incidental, special, exemplary or punitive damages, or for any loss of profits, revenue, business, contracts, goodwill, reputation, opportunity, anticipated savings, data or use, arising out of or in connection with this website, any material published on it, or your use of or inability to use it, even if the possibility of such loss was foreseeable or we were advised of it.
    3. Reliance.

      We are not liable for any loss arising from your reliance on material published on this website, or from any action you take or fail to take on the basis of it. Section 2 explains why you should take your own professional advice.
    4. Cap for Non-Customers.

      If you are not a customer, our total aggregate liability to you arising out of or in connection with this website, from all causes combined, will not exceed INR 500 (or its equivalent in USD). This cap reflects the fact that this website is made available to you free of charge and without any contract or payment, and is a reasonable allocation of risk on that basis.
    5. What Is Never Excluded.

      Nothing in this Disclaimer excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for any liability that cannot lawfully be excluded or limited, including under the Consumer Protection Act, 2019 where it applies to you, or for any liability arising under applicable data protection Law.
